OFFICE MEMORANDUM

Subject :- Central Civil Services (Leave Travel concession) Rules, 1988 – Fulfillment of Procedural requirements.

This Department is in receipt of a number of references regarding the procedural difficulties faced by the Government employees in application and settlement of the LTC claims. Sometimes, the Government servants claim that failure to follow the correct procedure was on account of a lack of knowledge of the rules/instructions while in the other cases the delay is caused in the late processing of LTC claims.

To remove these bottlenecks, this Department has decided to simplify the procedure of application and make the procedure of processing of LTC claims time bound.

The following time-limits shall be followed while processing the LTC applications/claims of the Government servants.

It may be noted that in cases where the place of posting of the Government employees is away from their Headquarters, additional 2 days transit-time may be allowed. The person proceeds on LTC after S.No.1 and 2 i.e. after ten days of applying LTC.

Under CCS (LTC) Ruler, the Government servants are required to inform their Controlling Officer before the journey(s) on LTC to be undertaken. It has now been decided that the Leave Sanctioning Authority shall obtain a self-certification from the employee regarding the proposed LTC journey.

The proforma for self-certification has been annexed with this O.M.

In addition to the above, it has been decided that whenever a Government servant applies for LTC, he/she may be provided with a copy of the guidelines (enclosed) which needs to be followed while availing LTC.

Employees may be encouraged to share interesting insights and pictures, if any, of the destination he/she visited while availing LTC on an appropriate forum.

One year has passed since the demise of Com. S. K. Vyas Ji, the 

OBSERVE COM. S. K. VYAS JI REMEMBRANCE DAY ON 
13th FEBRUARY 2016

One year has passed since the demise of Com. S. K. Vyas Ji, the legendary leader of Central Government employees and Pensioners on 13th February 2015.

Com. Vyasji was the Secretary General of the Confederation of Central Government Employees & Workers for forty years from 1967 to 2006. He was the President and Secretary General of All India Audit & Accounts Association for a long time. He continued as an Advisor of the Confederation and also as the General Secretary of National Coordination Committee of Pensioners (NCCP) and Bharat Central Pensioners Confederation (BCPC) till death.

Com. Vyas Ji has lead various struggles and strike actions of the Central Government Employees and was in the forefront of the leadership which organised the first strike action of the Central Government Employees after Independence, in the year 1960. Com. Vyas was jailed and dismissed from service. He played an important role in rallying the Central Government employees alongwith the striking Railway employees in the year 1974. He was an able and uncompromising negotiator with the Government in the JCM National Council and standing committee. He was responsible for many of the benefits and allowances enjoyed by the Central Government employees. The cost indexation of wages was earned by the Government employees through the sustained struggles and efforts in 1960s under his leadership. The Confederation of Central Government Employees & workers representing 1.5 million civil servants was in the forefront of the incessant struggles and strike actions organised by the Indian working class against the neo-liberal economic policies of the Government. Com. Vyas Ji’s vision and ideological clarity has made the Confederation, part and parcel of the mainstream of the working class movement of India.

Com. Vyasji was the friend, Philosopher, guide and everything for the Central Government employees movement. In the more than six decades long trade union life, Com. Vyasji endeared himself to every section of the Central Government employees. His death has caused an irreparable and irreplaceable loss to all of us. He was a great leader, symbol of simplicity, a gem of a person and a leader who is down to earth. Extremely polite, kind hearted and compassionate. One of the finest human being, tallest leader, a gentle mentor and a legend.

He is in our hearts! His memories will be forever with us! His long saga of struggle for the cause of the employees and workers will inspire the generations to come.

The National Secretariat of the Confederation calls upon all the affiliated organizations, State/District C-O-Cs to observe 13th February 2016 as S. K. VYAS JI REMEMBRANCE DAY by holding meetings, Seminar etc. throughout the country.

CONSTITUTION OF AN EMPOWERED COMMITTEE OF SECRETARIES TO PROCESS THE RECOMMENDATIONS OF THE 7TH CENTRAL PAY COMMISSION. 

            The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its approval for setting up an Empowered Committee of Secretaries under the Chairmanship of Cabinet Secretary, in order to process the recommendations of 7th Central Pay Commission (CPC) in an overall perspective.

            The Empowered Committee of Secretaries will function as a Screening Committee to process the recommendations with regard to all relevant factors of the 7th CPC in an expeditious detailed and holistic fashion.

            Under the RTI Act the CPIO is required to provide only the information which is available with him/her in the material form. The order of Hon'ble CAT in O. A. No.715/2012 had been implemented in respect of the petitioners in that O.A. even before the dismissal of the Review Petition by Hon'ble Supreme Court. 

            The question of implementation of the orders in respect of Pre-2006 pensioners has been under consideration in consultation with the concerned Ministries/ Departments i.e. Ministry of Law, Department of Legal Affairs and Ministry of Finance, Department of Expenditure and the file has been referred to Department of Legal Affairs on 30.12.2015. 

            Thus the information given by the CPIO was correct.

In case you are not satisfied with this order, you may appeal against the decision to the Central Information Commission within 90 days, as per the RTI Act.

7th CPC: Central government employees' salary hikes not before June?


New Delhi: Government is likely to accept the recommendations of the 7th Pay Commission and offer salary hikes to Central Government Employees not before June 2016.


Though, the matter may become clearer when Finance Ministry announces the details on implementation, and that is expected to happen before Budget 2016-17 in February.

Then there are Assembly elections expected in Pondicherry, Assam, Tamil Nadu, West Bengal, and Kerala. So the implementation of salary hike is also expected only when the State Assembly elections are over by June/July.

Also, as per reports, seven states: UP, Punjab, West Bengal, Tamil Nadu, Odisha, Tripura and Sikkim, have requested the Centre to delay implementation of salary hikes due to the financial burden 7th CPC recommendations are likely to cast on the state exchequer.

THE PAYMENT OF BONUS (AMENDMENT) ACT, 2015
NO. 6 OF 2016                                                                         [31st December, 2015.]
            An Act further to amend the Payment of Bonus Act, 1965.
BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:—
1. (1) This Act may be called the Payment of Bonus (Amendment) Act, 2015.

(2) It shall be deemed to have come into force on the 1st day of April, 2014.

2. In section 2 of the Payment of Bonus Act, 1965 (hereinafter referred to as the principal Act), in clause (13), for the words ‘‘ten thousand rupees’’, the words ‘‘twenty-one thousand rupees’’ shall be substituted.

3. In section 12 of the principal Act,—

(i) for the words ‘‘three thousand and five hundred rupees’’ at both the places where they occur, the words ‘‘seven thousand rupees or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher’’ shall respectively be substituted;

(ii) the following Explanation shall be inserted at the end, namely:—

‘Explanation.—For the purposes of this section, the expression ‘‘scheduled employment’’ shall have the same meaning as assigned to it in clause (g) of section 2 of the Minimum Wages Act, 1948.’

4. In section 38 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

‘‘(1) The Central Government may, subject to the condition of previous publication, by notification in the Official Gazette, make rules to carry out the provisions of this Act.’’.

COMMITTEE SET UP TO REVIEW WAGE STRUCTURE OF GRAMIN DAK SEVAKS 

            A one man Committee to examine the wage structure, service conditions, etc. of the Gramin Dak Sevaks in the Department of Posts has been constituted by the Government of India.

            Shri Kamlesh Chandra, Retired Member of Postal Services Board, will constitute the Committee. The Committee will be assisted by Shri T.Q. Mohammad, a Senior Administrative Grade Officer, who will act as Secretary to the GDS Committee. The Committee will go into the service conditions of Gramin Dak Sevaks and suggest changes as considered necessary. The terms of reference of the Committee will, inter-alia, include the following:-

    a)      To examine the system of Branch Post Offices, engagement conditions and the existing structure of wage and enrolments paid to the Gramin Dak Sevaks and recommend necessary changes;

    b)      To review the existing Services Discharge Benefits Scheme/other social security benefits for the Gramin Dak Sevaks and suggest necessary changes;

    c)      To review the existing facilities/welfare measures provided to the Gramin Dak Sevaks and suggest necessary changes;

    d)     To examine and suggest any changes in the method of engagement, minimum qualification for engagement as Gramin Dak Sevaks and their conduct and disciplinary rules, particularly keeping in view the proposed induction of technology in the Rural Post Offices.

            The Department of Post has 2.6 lakh Gramin Dak Sevaks. All these GDSs will come under the purview of GDS Committee.
