Will the Minister of LABOUR AND EMPLOYMENT be pleased to state:

(a)whether the Government proposes to amend the Minimum Wages Act, 1948 and formulate a uniform wage policy for the entire country and if so, the details and salient features thereof;

(b)whether minimum wages fixed under the Minimum Wages Act, 1948 varies amongst States;

(c)if so, the details thereof, State/UT-wise along with the reasons for differential wages especially on gender basis and also between urban and rural areas;

(d)whether any monitoring mechanism exists to ensure that all the workers are paid minimum wages and not subjected to any form of exploitation; and

(e)if so, the details thereof along with other labour welfare measures being implemented by the Government for betterment of labour force in the country?

STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (e) OF THE LOK SABHA STARRED QUESTION NO. 48 FOR 06.02.2017 BY SHRI KUNWAR PUSHPENDRA SINGH CHANDEL AND PROF.RAVINDRA VISHWANATH GAIKWAD REGARDING MINIMUM WAGES.

(a): The proposed amendments to the Minimum Wages Act, 1948, inter-alia, includes applicability of minimum wages to all employments, changes in the definition of “Appropriate Government”, fixation/review/revision of minimum rates of wages by the State Government, introduction of National Minimum Wage by the Central Government, enhancement of penalty, etc.

As a step towards a uniform wage structure, the concept of National Floor Level Minimum Wage (NFLMW) was introduced by the Government in 1996 on a voluntary basis. It is revised from time to time taking into account the increase in the Consumer Price Index Number. NFLMW has been revised to Rs.160/- per day w. e. f 01.07.2015.

(b) & (c): Under the provisions of the Minimum Wages Act, 1948, both Central and State Governments are appropriate Governments to fix, review and revise the minimum wages of the workers employed in the scheduled employment under their respective jurisdictions. As regards minimum wages in States, there is disparity due to variations in socio-economic and agro-climatic conditions, income, prices of essential commodities, paying capacity, productivity and local conditions. As per the available information, a statement showing the range of rates of minimum wages in all the States/Union Territories is at Annexure.

The Act does not discriminate on the basis of gender and the female workers are entitled to same wages and other facilities as fixed by the Central Government for the workers engaged in the scheduled employments. No separate wages are fixed for urban and rural areas.

(d) & (e): The implementation of the Act is carried out by the Centre as well as the States in respect of their respective jurisdiction. In the Central Sphere, the enforcement is secured through the Inspecting Officers of the Chief Labour Commissioner (Central) commonly designated as Central Industrial Relations Machinery (CIRM), the compliance in the State sphere is ensured through the State Enforcement Machinery. They conduct regular inspections and in the event of detection of any case of non-payment or under-payment of minimum wages, they advise the employers to make payment of the shortfall of wages. In case of non-compliance, penal provisions against the defaulting employers are invoked.

The labour welfare measures recently initiated for betterment of labour force include minimum pension of Rs.1000/-per month to the pensioners under Employees’ Pension Scheme (EPS), 1995, portability of provident fund account, National Career Service portal, Employees State Insurance Corporation 2.0(Health Reforms of ESIC), Revision in eligibility and calculation ceiling under the Payment of Bonus Act, 1965 etc.

1. All General Secretaries of NFPE will consult with Circle leaders and if any change is required can make suitable change.

2. Leaders whose names are given should compulsorily attend the meeting.

3. Circle Secretaries of NFPE should take initiative to arrange the joint meeting. They should consult each other and finalise the programme and arrange grand meetings.

4. Maximum publicity should be given to campaign programme and maximum participation of employees should be ensured.

5. Circle Unions / Divisional Unions should make maximum effort to make the strike a grand success. Joint campaign programme by Circle / Divisional Union Leaders may be organized in all Circles / Divisions.

Rs 9000 Minimum Pension for Central Govt Employees: MoS PM

New Delhi: The minimum pension has been increased to Rs 9,000 per person besides a two-fold hike in ex-gratia amount for central government employees, Union Minister Jitendra Singh said on Thursday.

Addressing the 29th meeting of the Standing Committee of Voluntary Agencies (SCOVA) here, he said almost 88 per cent of
pension accounts have been seeded to Aadhaar.

There are about 50-55 lakh pensioners in the country, said Singh, Minister of State in Prime Minister's Office.

He further said that minimum pension has been increased to Rs 9,000 per person and ex-gratia amount has been increased
from Rs 10-15 lakh to Rs 25-35 lakh, as per a release issued by Personnel Ministry.

The SCOVA meeting is organised by the Department of Pensions and Pensioners' Welfare (DoP&PW).

Singh said there is a need to put in place an institutionalised mechanism to make good use of the knowledge, experience and efforts of the retired employees which can help in the value addition to the current scenario.

He said the retired employees are a healthy and productive workforce for India and we need to streamline and channelise their energies in a productive direction.

"We should learn from the pensioners' experience," said Singh.

The minister also said that the DoP&PW should be reoriented in such a way that pensioners become a part of nation building process.

Many issues related to pensioners were discussed threadbare, such as revision of Pension Payment Orders of Pre-2006 pensioners, health insurance scheme for pensioners including those residing in non-Central Government Health Service (CGHS) area and special higher family pension for widows of the war disabled invalidated out of service, etc.

The meeting was attended by the member of pensioners associations and senior officers of the important departments
of the central government.

NOTICE

Sir,

In accordance with the provisions of Sub Section (1) of Section 22 of the Industrial Disputes Act, 1947, we hereby notify that all the Postal/RMS/MMS/Administrative & Postal Accounts Employees and the Gramin Dak Sewaks (NFPE) will go on 1 Day Strike on 16^th March,2017.

The Charter of Demands is enclosed herewith.

CHARTER OF DEMANDS PART-A

1. Settle the demands raised by NJCA regarding modifications of 7^th CPC recommendations as submitted in the memorandum to Cabinet Secretary on 10^th December 2015. (See Annexure-I). Honour the assurance given by the Group of Ministers to NJCA on 30^th June 2016 and 6^thJuly 2016, especially increase in minimum wage and fitment factor. Grant revised HRA at the existing percentage itself i.e. 30%, 20% and 10%. Accept the proposal of the staff side regarding Transport Allowance. Settle all anomalies arising out of implementation of 7^th CPC recommendations, in a time bound manner.

2. Implement option-I recommended by 7^th CPC and accepted by the Government regarding parity in pension of pre-2016 pensioners, without any further delay. Settle the pension related issues raised by NJCA against item 13 of its memorandum submitted to Cabinet Secretary on 10^th December 2015. (See Annexure-I).

3. Scrap PFRDA Act and New Pension System (NPS) and grant pension and Family Pension to all Central Government employees recruited after 01.01.2004, under CCS (Pension) Rules 1972.

4. Treat Gramin Dak Sewaks of Postal department as Civil Servants, and extend all benefits like pay, pension, allowances etc. of departmental employees to GDS. Publish GDS Committee report immediately.

5. Regularise all casual, contract, part-time, contingent and Daily rated mazdoors and grant equal pay and other benefits. Revise the wages as per 7^th CPC minimum pay.

6. No Downsizing, Privatisation, outsourcing and contractorisation of Government functions.

7. Withdraw the arbitrary decision of the Government to enhance the bench mark for performance appraisal for promotion and financial upgradations under MACP from “GOOD” to VERY GOOD” and also decision to withhold annual increments in the case of those employees who are not able to meet the bench march either for MACP or for regular promotion within the first 20 years of service. Grant MACP pay fixation benefits on promotional hierarchy and not on pay-matrix hierarchy. Personnel promoted on the basis of examination should be treated as fresh entrants to the cadre for grant of MACP.

8. Withdraw the draconian FR 56 (J) and Rule 48 of CCs (Pension) Rules 1972 which is being misused as a short cut as purity measure to punish and victimize the employees.

9. Fill up all vacant posts including promotional posts in a time bound manner. Lift ban on creation of posts. Undertake cadre Review to access the requirement of employees and their cadre prospects. Modify recruitment rules of Group-‘C’ cadre and make recruitment on Reginal basis.

10. Remove 5% ceiling on compassionate appointments and grant appointment in all deserving cases.

11. Grant five promotions in the service carreer to all Central Govt. employees.

12. Abolish and upgrade all Lower Division Clerks to Upper Division Clerks.

13. Ensure parity in pay for all stenographers, Assistants, Ministerial Staff in subordinate offices and in all organized Accounts cadres with Central Secretariat staff by upgrading their pay scales. Grant pay scale of Drivers in Loksabha Secretariat to Drivers working in all other Central Government Departments.

14. Reject the stipulation of 7^th CPC to reduce the salary to 80% for the second year of Child Care leave and retain the existing provision.

15. Introduce Productivity Linked bonus in all department and continue the existing bi-lateral agreement on PLB wherever it exists.

16. Ensure cashless medical treatment to all Central Government employees & Pensioners in all recognized Government and Private hospitals.

17. Revision of Overtime Allowance (OTA) and Night Duty Allowance (NDA) w.e.f 01.01.2016 based on 7^th CPC pay scale.

18. Revision of wages of Central Government employees in every five years.

19. Revive JCM functioning at all levels. Grant recognition to the unions/Associations under CCS (RSA) Rules 1993 within a time frame to facilitate effective JCM functioning.

20. Implementation of the Revised Pay structure in respect of employees and pensioners of autonomous bodies consequent on implementation of CCS (Revised Pay) Rules 2016 in respect of Central Government employees and pensioners w.e.f. 01.01.2016.

21. Implementation of the “equal pay for equal work” judgement of the Supreme Court in all departments of the Central Government.

1. Settle the demands of various cadres of Postal department relating to 7^th CPC recommendations submitted to Secretary, Posts in memorandum dated 08.12.2015.

2. Implement cadre restructuring in all remaining cadres in the Department of Posts and settle the residual issues arising at implementation stage. Finalize RRs in MMS Cadres.

3. Grant Civil Servant status to Gramin Dak Sevaks and grant all benefits of departmental employees on pro-rata basis./Publish GDS Committee Report.

4. Revision of wages and payment of arrears from 01.01.2006 to all casual, part-time, contingent and daily-rated mazdoors and regularization of services.

7. Revision of OTA & OSA and fixation of norms for CRC/Speed post and Parcel in RMS and FMC for Postman Cadre.

8. Settle problems arisen out of implementation of CSI and CBS.

9. Grant of upgraded 3050 pay scale to Postmen w.e.f. 1.1.1996 as per Supreme Court Judgment.Change of RRs of Postmen/MTS.

10. Withdraw “Very Good” bench mark condition for MACP and future increments and holding of DPCs timely..

11. Grant of S D.A. & HCA to the Assam & NE & remove discrimination..

12. Problems arisen out of demonetization Scheme and grant additional remuneration of full day salary for Sunday/Holiday and hourly rate for extended duty hours. Provide proper infrastructure including fake currency detector and counting machines. Not to direct the officials to make good the loss where fake currency machines are not provided.

13 Stop Sunday/Holiday working completely.

14. Discussion on Memorandum of AIPSBCOEA.

15. All COs/ROs & DPLI office Kolkata may be allowed to function CPCs.

16. Finalization of Recruitment Rules of AAO Cadre in Postal Accounts and review of result for SC/ST -2012 Exam.

Dear Comrades,

As Assembly elections to five States are scheduled to be held from February 4th to March 11th (including declaration of results) and as February 15th is also poll date in two states , the National Secretariat of Confederation of Central Government Employees & Workers has decided to postpone the proposed ONE DAY STRIKE on February 15th to MARCH 16th 2017 THURSDAY.

As 13th March is holiday for Holi in North India and the celebrations are to continue on 14th also, the strike date is fixed as 16th March. There is no change in the 10th January Mass Dharna Programme.

All those Organisations who had served the strike notice as February 15th shall give a letter to their Head of the Departments intimating the postponement of the strike to 2017 March 16th , showing reasons as mentioned above , WITHOUT FAIL.

Those organisations who have not yet served the Strike Notice should serve the notice before 15th January 2017 WITHOUT FAIL.

Regarding already announced campaign programme of National Secretariat members , if necessary , dates may be rescheduled by the National Secretariat members in consultation with the concerned C-O-Cs.

General Secretaries of C-O-Cs are also requested to contact IMMEDIATELY, the concerned National Secretariat members and finalise the date of campaign programme. Intensive campaign should be conducted by all C-O-Cs and Affiliated Organisations in all States, especially in those states where elections are declared, so that employees and general public will become aware of the totally negative attitude of the Central Government towards the legitimate demands of the Central Government Employees and Pensioners.

The betrayal of the Group of Cabinet Ministers of NDA Govt by not fulfilling their assurance given to NJCA leaders on 30th June 2016, should be exposed.

OFFICE MEMORANDUM

Sub: Amendment in RRs for revising the upper age limit as 30 years for the recruitment made under Combined Graduate Level Examination conducted by SSC for the post carrying Grade Pay of Rs. 4200, 4600 & 4800/-.

The undersigned is directed to refer to this Department’s O.M. of even number dated 31st May, 2016 issued in pursuance of meeting in DoPT on the issue cited in subject above. All the participant Ministries/Departments were requested to send a proposal for amendment of the Recruitment Rules for the posts having Grade Pay of Rs. 4200/-, 4600/- and 4800/- which are part of CGLE so as to revise the upper age limit as 30 years, in consonance with the guidelines on framing/amendment of Recruitment Rules dated 31.12.2010.

2. Further, DoPT vide OM dated 14.09.2016 requested all participating Ministries / Departments to convey the status for amendment of the RRs of the posts carrying Grade Pay Rs. 4200, 4600 & 4800/- and to furnish a copy of the notification of the Recruitment Rules.

3. A statement containing the details of the posts for which recruitment rules are required to be amended is enclosed. The cadre controlling authorities of respective Ministries/Departments are requested to inform this Department about the current status of amendment. A copy of the notification issued for amendment in RRs may be sent to this Department latest by 10.01.2017.
