 Sub:-   Observance of All India protest day on 19th November 2015

Dear Comrade,

            All of you may recall that the NJCA in its meeting held on 30th September 2015 in Delhi after considering the delay in submission of the report of the 7th CPC as also broadly taking stock the speculating and detail deliberations, unanimously decided to defer the proposed Indefinite  General Strike of the Central Government Employees till next Budget Session and symmetrically it was also resolve to observe 19th November 2015 as Joint Nation wise protest day to all the country to press upon the Government of India to resolve the long pending
legitimate demands of all the Government Employees.

            All of you are therefore accordingly requested to take all necessary steps to jointly observe protest day on 19th November 2015. As per decision taken by the NJCA in the said meeting the member of the NJCA shall stage one day Dharna at Jantar Mantar in New Delhi on the said day.

Charter of Demands

1.         Effect wage revision of Central Government employees from 1.12014 accepting the memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA. Ensure submission of the 7th CPC report with the stipulated time frame of 18 months; include Grameen Dak Sewaks within the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.

2.         No privatisation, PPP or FDI in Railways and Defence Establishments and no corporatisation of postal services;

3.         No Ban on recruitment/creation of post.

4.         Scrap PFRDA Act and re-introduce the defined benefit statutory
pension scheme.

5.         No outsourcing; contractorisation, privatization of governmental functions; withdraw the proposed move to close down the Printing Presses; the publication, form store and stationery departments and Medical Stores Depots; regularise the existing daily rated/casual and contract workers and absorption of trained apprentices;

6.         Revive the JCM functioning at all levels as an effective negotiating forum for settlement of the demands of the CGEs.

7.         Remove the arbitrary ceiling on compassionate appointments.

8.         No labour reforms which are inimical to the interest of the workers.
9.         Remove the Bonus ceiling;

10.       Ensure five promotions in the service career.

OROP NOTIFICATION ISSUED BY GOVERNMENT

Notification for Implementation of OROP Issued

The Government today issued the notification regarding implementation of ‘One Rank One Pension’ in respect of Defence Forces personnel. Salient features of the OROP as stated in the Order are as follows:
I. To begin with, pension of the past pensioners would be re-fixed on the basis of pension of retirees of calendar year 2013 and the benefit will be effective with effect from 1.7.2014.
II. Pension will be re-fixed for all pensioners on the basis of the average of minimum and maximum pension of personnel retiring in 2013 in the same rank and with the same length of service.
III. Pension for those drawing above the average shall be protected.
IV. Arrears will be paid in four equal half yearly instalments. However, all the family pensioners, including those in receipt of Special/Liberalized family pensioners, and Gallantry award winners shall be paid arrears in one instalment.
V. In future, the pension would be re-fixed every 5 years.
* Personnel who opt to get discharged henceforth on their own request under Rule 13(3)1(i)(b),13(3)1(iv) or Rule 16B of the Army Rule 1954 or equivalent Navy or Air Force Rules will not be entitled to the benefits of OROP. It will be effective prospectively.
* The Govt. has decided to appoint a Judicial Committee to look into anomalies, if any, arising out of implementation of OROP. The Judicial Committee will submit its report in six months.
* Detailed instructions along with tables indicating revised pension for each rank and each category, shall be issued separately for updation of pension and payment of arrears directly by Pension Disbursing Agencies.

NCCPA AIC AT KOLKATA

3rd TREIENNIAL ANNUALCONFERENCE
6-7, NOVEMBER, 2015

            The 3rd TRIENNIAL AIC of NCCPA was held in Kolkata from 6th to 7th November, 2015. Comrade R.L.Bhattacharjee Chairman NCCPA presided over the AIC. 200 Delegates and Observers from all over the country representing 25 affiliates, in addition to West Bengal Pensioners, have attended the AIC. The AIC had a spectacular start with an impressive procession by the Pensioners. At the end of the procession the National Flag was hoisted by senior leader of P&T Trade Union movement Comrade Sisir Bhattacharya and the NCCPA flag was hoisted by the Chairman NCCPA Comrade RLB. The homage to the Martyrs Column was impressive with the former Finance Minister of West Bengal Government Comrmade Asim Dasgupta paying floral tributes that was followed by all other leaders and Delegates and Observers. Before the formal inauguration cultural folk songs were sung by the Kolkata CG Employees.

            The inaugural session was impressive with a galaxy of leaders decorating the  dais and addressing the AIC. Comrade Asim Dasgupta former FM delivered the inaugural address. The inaugural session was addressed by Comrades KKN.Kutty (Chairman Confederation of CG Employees); Piyush (State General Secretary of West Bengal State Committee of Confederation); VAN.Namboodiri (Patron NCCPA); Subroto Majumdar (WB State COC of CGPA Association); Aparesh Bhattachargee (Bank Pensioners Association); Himadri Roy (LIC Pensioners Association); Subhendu Mukherjee (Railway Pensioners Association); and others. 

            The Subjects Committee was also presided over by Comrade RLB. The House paid homage to all departed leaders and dignitaries from different walks of life. The Report of the Secretary General was placed for adoption by the Secretary General Comrade Pavitra Ranjan Chakraborty. In the debate that followed in the afternoon of the day and on the forenoon of the second day of the AIC various Office Bearers of NCCPA, Chief Executives of Affiliated All India Associations including AIPRPA and State and District CGPA organisations and Delegates belonging to various organisations including AIPRPA have too part. With the summing up of the discussion by the Secretary General Comrade Pavitra, the Report of the Secretary General and the Audited accounts have been adopted.
Various Resolutions including on Policy and Programme that declared the solidarity support to the 19th November Central Government Employees programme; Affiliation to the international pensioners organisation called the TUI-Pensioners & Retired; Opposition to escalating price rise; Against the communalism; Observing the 13th February of each year as the Memorial Day of Comrade S.K.Vyas; Demanding implementation of Court judgments to all similarly placed without dragging all to courts for unnecessary legal battle were some of the important resolutions adopted by the House. 

            The debate brought home that formation of Departmental wise All India Pensioners Associations for bigger departments will result in strengthening of NCCPA in all States. The AIC paid maximum concentration to the efforts of building a stronger NCCPA as well building a strong united platform of all CG Pensioners organisations to meet out the situation arising out of the submission of recommendations by the 7th CPC shortly. 

            The open session was the concluding session in which Comrade Basudev Acharya former M.P who always fought for our cause both inside and outside the parliament addressed elaborately on the type of attacks let loose on the workers and pensioners. The Open Session was also addressed by Comrade KKN.Kutty and also by Comrade Sujatha Saha the Councillor of Kolkata Municipal Corporation.

STRIKE NOTICE SERVED TO THE SECRETARY DEPARTMENT OF POSTS BY NFPE LEADERS ON 06th NOVEMBER-2015.

            Start intensive preparations for making 1st & 2nd December, 2015 strike a historic success.

Removal of Grade Pay System in 7th Pay Commission – A detailed report
Will the removal of Grade Pay System by the 7th Pay Commission help Central Government employees? – This is the topic of this article.
“Unconfirmed reports say that the 7th Pay Commission is very likely to recommend the abolishing of the Grade Pay System introduced by the 6th Pay Commission.”
Not only the Government, but the Central Government employees too are hoping and wishing that the 7th Pay Commission functions independently, free from interventions. The report of the previous Pay Commissions will guide for determining the revision of pay scale and pay bands, allowances, retirement benefits and other facilities/benefits of more than 50 lakh employees. The Pay Commission also considers the recommendations, suggestions and inputs gathered from employees all over the country and presented as memorandums by federations like the NC JCM and the Confederation.
There is no rule that the new Pay Commission has to follow the same methodology and determination followed by the previous Pay Commissions. Therefore, one cannot state for sure that the 7th Pay Commission will tow the guidelines issued by the 6th or the 5th Pay Commission while deciding the new pay scale and pay bands.
One has to keep in mind the fact that the 6th Pay Commission was radically different from the recommendations and guidelines issued by the 5th Pay Commission. One has to also remember that a number of industry experts, who predicted the recommendations of the 6th Pay Commission based on the trends of the previous Pay Commission, were proved completely wrong.
If one Pay Commission has the right to recommend the splitting of the Pay Scale into two, the next Pay Commission has all the powers to completely abolish the system. But, this is not the issue!
Will the Central Government employees benefit by the removal of the Grade Pay system? This is the question now.
It will definitely be beneficial. Here are the reasons why.
It is unacceptable that a promotion, which comes after waiting for many years, brings with it an increment of just Rs.100.
None has until now accepted the splitting of the promotional hierarchy, which had been followed for years, into two.
The anomalies that prevailed due to the ‘Grade Pay Hierarchy’ which was introduced under the MACP promotional system, still remain unresolved.
When the discussions and debates on MACP system continued to grow unabated during the NC JCM Anomaly Committee meeting, it was decided that a separate meeting ought to be held to analyze this issue.
Most of the individual requests from the Central Government employees this time are about the MACP promotional system. The reason is the Grade Pay structure introduced by the 6th Pay Commission.
And also can list out many reasons to abolish the Grade Pay System.

(i)        Include GDS in 7th CPC for wage revision and other service related       matters.


(ii)       Implement cadre Restructuring proposals in all cadres including Postal          Accounts      & MMS.


(iii)      Fill up all vacant posts in all cadres of Department of Posts (i.e. PA, SA,          Postmen, Mail Guard, Mail Man, GDS Mail Man, MMS Driver & other staff in         MMS, PA       CO, PA SBCO, Postal Accounts, Civil & Electrical         Wing Staff, as          per actual sanctioned       strength.


(iv)      Stop all types of harassment in the name of implementation of various            new    services and schemes and Trade Union Victimization.

Dear Comrades,

            NFPE alongwith AIPEUGDS (NFPE) has taken decision to go on 48 hours strike on 1st & 2nd December, 2015 on the four point\s charter of demands.

            NFPE had requested Secretary (P) in writing and by meeting personally to resolve the issues which are pending since long. But it is a very sorry state of affairs on the part of Department of Posts that neither any issue is settled nor even a single line in reply is being given.

            As you all are  aware that NFPE along with PJCA had declared indefinite strike from 6th May-2015 onwards. On most of the items  Secretary (P)  gave positive  assurance in writing in the meetings  during negotiations on agenda of strike Charter of demands and the minutes were circulated among all and were published in all union journals. On 5th May Honourable Minister  Communication also called  meeting with both Secretary Generals NFPE & FNPO and  he also gave positive assurances including  GDS wage revision by 7th CPC and for Cadre restructuring he told  that  he has signed the file after approving the proposals and handed over to Secretary Post.

            But after a lapse of 6 months period no progress is being noticed in any of the matter.

            Earlier National Joint Council of Action  of Constituent Organizations of National  Council JCM had taken  decision to go on indefinite  strike  from 23rd  November -2015 in which  our main demand of inclusion of GDS was also  included in the Charter of  demands

            It was expected that Pay Commission will submit its report upto 30th September, 2015. Pay Commission requested to grant 2 months extension to wind-up the office but the Government of India was very much generous to grant 4 months extension to Pay Commission. Pay Commission has completed its task but now Government is interfering and Secretary Finance Ministry has directed Pay Commission to give recommendations keeping in view the fiscal condition of the country and it should not give such recommendations which cannot be implemented. NJCA had deferred the decision of strike from 23rd November, 2015. We as NFPE told in the meeting of NJCA that we are going on indefinite strike in Postal. NJCA leadership requested to review  and reconsider  the decision and change the  date as NJCA has given call of a grand Dharna by All India  leaders of NJCA at Jantar Manter, New Delhi on 19 November,2015. Some of our Confederation leaders and senior leaders of NFPE also advised to review the decision. Accordingly NFPE Federal Secretariat meeting was held at Hyderabad on 11.10.2015 and reviewed the situation and unanimous decision was taken to organize 48 hours strike on 1st & 2nd December, 2015 on the following 4 points of Charter of demands:

            (i) Include GDS in 7th CPC for wage revision and other service related matters.


            (ii) Implement cadre Restructuring proposals in all cadres including Postal       Accounts      & MMS.


            (iii) Fill up all vacant posts in all cadres of Department of Posts (i.e. PA, SA,     Postmen, Mail Guard, Mail Man, GDS Mail Man, MMS Driver & other staff in        MMS, PA       CO, PA SBCO, Postal Accounts Staff, Civil & Electrical Wing Staff, as         per actual sanctioned        strength.


            (iv) Stop all types of harassment in the name of implementation of various      new    services and schemes and Trade Union Victimization.

BRIEF OF JUSTIFICATION OF DEMANDS

(i).       INCLUDE GDS IN 7TH CPC FOR WAGE REVISION AND OTHER SERVICE      RELATED MATTERS.

            Gramin Dak Sewaks constitute 50% of Work Force in Department of Post. They run 89% Post Offices in Rural Areas. Since 2nd Pay Commission, every  time a Committee headed by bureaucrats  has been constituted to look into the wage revision  and other service related matters  except at the time of Vth  Pay Commission when Justice  Talwar  Committee  was formed which gave  very favourable  recommendations to the GDS  but Government  did not implement 25% of its recommendations. This time NFPE raised the issue to include GDS in 7th CPC and this was supported by Confederation and National Council JCM. But Government has not given any attention towards this demand. During the negotiation on Strike  Charter of demands, Secretary (Post) assured to refer the matter  to Government  of India again third time  with strong recommendations  and  on 05.05.2015 , Hon`ble  Minister Communication had also assured to use his influence to get the GDS included in 7th CPC but nothing has been done so far. It is coming to the notice by some sources that Department of Post is going to form bureaucratic Committee again. We have requested several times that when Pay Commission complete its task than this matter should  also be given to him . Now Pay Commission has been allowed to sit idle for 3 months. This period might have been utilized for the wage revision of GDS. But Government of India is not at all concerned about this poor deprived and exploited section of working class. We cannot tolerate this state. So we have to go to agitation to fight this injustice and discrimination.

(ii).       CADRE RESTRUCTURING

            Cadre Restructuring proposals were finalized by the Committee 2 years before. On 5th May 2015 Minister also approved.  JS&FA also cleared the proposals. DOP&T has not raised any objection and suggested to take clearance from Finance Ministry. There is no more financial implications even that Finance Ministry has not cleared the proposal. We have asked Department of Post several times but nothing has been done so far. If it is not implemented before implementation of 7thCPC report. It will be of no use.

(iii).     FILL UP ALL VACANT POSTS IN ALL CADRES OF DEPARTMENT OF POSTS.

            Though Recruitment is going on in the Department of Posts here and there. But there is acute shortage of staff in all cadres because recruitment is not being done as per actual sanctioned strength. If recruitment is made as per actual sanctioned strength and shortage is met out then 50%   problems will be solved automatically.
 
(iv).      STOP ALL TYPES OF HARASSMENT IN THE NAME OF IMPLEMENTATION OF      VARIOUS             NEW   SERVICES AND SCHEMES AND TRADE UNION    VICTIMIZATION.

            Our staff in all cadres is facing so much harassment and victimization. Every day any new service or scheme is being launched without proper infrastructure and sufficient man power. CBS and CSI biggest problem for P-III, 100% delivery for Postmen. Harassment of staff in RMS on OTA, More problems in Circle Office, Postal Accounts and Civil Wing and Electrical Wings are being faced due to staff shortage. If any Trade union leader raises his voice against these onslaughts, he is victimized. Holding of Melas and Meetings on every Sunday and Holiday has become the regular practice against the directions given by Secretary (Post).

            So keeping in all these we have to fight against all these onslaughts and wrong policies of department of Posts and Government of India.

            Whatever we have achieved that is due to struggle only. We have achieved so many things in past by struggles only. If we fight unitedly we will win sure.

            For making the strike 100% successful please follow the following instructions:


1.         Campaign programme of All India leaders have been declared and published in websites, all circle secretaries of NFPE affiliated unions are requested to consult each other and make all arrangements for the meetings of All India leaders. If any change is needed, can be made with consultation of all.

2.         All India leaders should attend the programmes compulsorily.

      3.           Maximum publicity should be given to the campaign programme.

      4.         Strike notice will be served on 06.11.2015 to the Secretary (Posts) by NFPE leaders.It should be served at all levels by organizing mass demonstrations.

      5.         Joint campaign programme should be conducted by all Circle/Divisional Secretaries in their respective Circles and Divisions and make maximum efforts for grand success of strike by organizing Gate meetings and General Body meetings.

      6.          Circulars/Pamphlets /Hand bills and Posters should be published and send to all. These should be published in regional language also.

7.         Please leave no stone unturned for success of strike.

8.         Give Wide Publicity in local Press and Media.
