Subject: Guidelines on Air Travel on Tours/LTC

The undersigned is directed lo invite a reference to Ministry of Finance, Department of Expenditure's O.M.No.19024/1/2009-E.IV. dated 16.09.2010 (copy enclosed) on the subject cited above.


2. It has been observed that various instances have come to the notice that officers from Department of Revenue and the Iwo Boards Central Board of Direct Taxes and Central Board of Excise and Customs are still not following the guidelines provided the Department of Expenditure's O.M, referred above. Either the air tickers are booked through an agent other than the Authorized Travel Agents or the journey is performed by the private air fines in contravention of the instructions issued by the Department of Expenditure. Therefore oil the concerned officers are requested to strictly adhere to the instructions of Department of Expenditure on the air travel on tours/LTC.

OFFICE MEMORANDUM
Subject: Guidelines on Air Travel on Tours/LTC.

This Department is receiving repeated references seeking clarifications with regard to purchase of Air tickets through authorized agents and relaxation for travel by Airlines other than Indian Airlines. The following guidelines may be noted for compliance:

1. On Official Tours:

(i) For travel by Airlines other than Air India because of operational or other reasons or on account of non-availability of Air India flights, individual cases for relaxation to be referred to M/o Civil Aviation, as stated in this Ministry's OM No. 19024/1/2009-E.IV dated 13.07.09.

(ii) Air Tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours.

2. LTC:

(i) Travel by Air India only.

(ii) In Economy class only, irrespective of entitlement.

(iii) LTC-80 ticket of Air India only to be purchased.

(iv) Air Tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours and IRCTC (to the extent IRCTC is authorized as per DoP&T OM No. 31011/6/2002-Estt.(A) dt. 02.12.09).

3. LTC for J&K:

(i) Relaxation to travel by Private Airlines to visit J &K while availing LTC is available to all the categories of Govt. employees, including those entitled to travel by Air [DoP&T OMs No. 31011/2/2003-Estt.(A-IV) dated 18.06.10 and 05.08.10 refer].

(ii) For purchase of Air tickets, however, the procedure as given under para 2 (iv) above should be followed.

4. All Ministries/Departments of Govt. of India are requested to strictly adhere to these instructions.

Dopt Notification : Fundamental (First Amendment) Rules, 2014

NOTIFICATION
New Delhi, the 17th January, 2014
G.S.R. 27(E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rule further to amend the Fundamental Rules, 1922, namely :-

1. (1) These rules may be called the Fundamental (First Amendment) Rules, 2014. 
(2) They shall came into force on the date of their publication in the Official Gazette.
2. In the Fundamental Rule, 1922, in rule 56, -
(a) in clause (k), in sub-clause (1), for item (c), the following shall be substituted namely :
“(c) it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire under this clause, if,-
(i) the Government servant is under suspension: or
(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending_
Explanation :– For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;
(b) for clause (m), the following shall be substituted, namely :-
“(m) A Government servant in Group ‘C’ post who is not governed by any pension rules, may, by giving notice of not less than three months in writing to the Appropriate Authority, retire from service after he has completed thirty year’s service :
Provided that it shall be open to the Appropriate Authority to withhold permission to a Government servant, who seeks to retire proceedings.”;
(i) the Government servant is under suspension; or
(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.
Explanation :-For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceedings.”;

Merger of 50 percent DA may soon be considered by Central Government – Sources
Sources close to the Central Government Employees Federations told that Merger of 50% DA will soon be considered by Central Government before the budget session of Parliament in February 2014. According to the sources, the central government is likely to consider the central government employees  demand for merging of 50 % DA, for the reason that the DA will be crossing 100% level after January 2014.

The rate of dearness allowance to be paid to govt servants has been increasing consistently due to the rise in the prices of essential commodities for the past two years. In 2011 the rate of DA was at 50 % level. Since then all the Federation demanded the central government to merge the 50 Percent DA with basic Pay. But the government did not accept this demand to merge the DA with basis pay, as it was not recommended by sixth CPC.
The demand would be considered in view of parliament elections
But federations kept on demanding the government that raising dearness allowance alone will not help to compensate the alarming rate of price rice. So they urged the government to consider their demand favorably. It is believed that after the defeat in the election of four state legislative councils, the UPA government has decided to reconsider about its decision on the issues which directly affects the common public. The high command of the ruling party thought that the reason for their defeat in the state election is mainly because of their government failed to contain the price rise. The gap between common public and UPA government has been considerably increased. To correct these failures the UPA government decides to do something to attract the voters.
After announcing the government’s proposal to constitute the 7th pay commission, the community of central government employees has been convinced to have soft view on this government. Further the 50 lakh central government employees would be made happy if the 50% DA is merged with Basic Pay. It is told that , as the central government staff association and federations demanding it very seriously, in case the government decides go with this demand, there will be around one crore voters will be in favour of UPA government. So the government may consider the demand of merging of 50% DA with basic Pay in view of forthcoming Parliament elections.
Allowances will have no impact on merging DA with basic Pay
The sources, associated with National Council JCM, said that the government initially was not willing to consider this demand as some allowance and advances have been raised by 25% whenever the DA crosses 50% level as per the sixth CPC recommendation. But federations insisted that the allowances, which are raised to 25 % level when DA crosses 50%, will have no impact on merging DA with basic pay. The only allowance will have an increase when Basic Pay increases are HRA. No other allowances will be increased and other entitlement of the respective Grade Pay will not be revised as the 50% DA to be merged will be kept under separate component like it was treated in 5CPC as Dearness Pay. “There is no need to worry about financial implications, as the 50% DA will be paid by just changing its nomenclature as Dearness Pay”, said sources.
50% DA merger to be decalered before DA crosses 100%
Further, it has been informed that it is good enough for the government to announce its decision before declaring the next additional installment of DA. Because the AICPIN for Industrial workers for the Month of December 2013 is awaited to determine the rate of dearness allowance to be paid from January 2014.The result of last 11 months AICPIN shows that DA will definitely be raised by 10 % from existing 90% level. So the rate of DA will be 100% with effect from 1st January 2014. After the DA increased to 100%, the demand for 50% DA merger will have to change its avatar. Probably the demand would be for 100% DA merger. So the federations expect the government may consider 50% DA merger soon.
However, decision if any in this regard should be taken before the announcement of election for parliament. It is expected that election announcement for parliament will be made by the end of February 2014. Before that,  the announcement of 50% DA merger is expected from central government.

Dear Comrades,
As you are aware, the extended National Executive of the Confederation held at New Delhi on 10.01.2014 has decided to organize 48 hours (2 days) Nationwide strike of Central Government Employees on 12th and 13th of February 2014. Strike Notice will be served to Cabinet Secretary, Government of India by Confederation and to Secretary, Department of Posts by NFPE and all its affiliated unions on 21.01.2014.
Main Demands of the two days strike are
1.     DA Merger
2.     Interim Relief
3.     Inclusion of GDS in 7th CPC
4.     Date of effect of 7th CPC 01.01.2014
5.     Regularisation and Revision of wages of Casual laburers.
6.     Rescind the PFRDA Act and scrap New Pension Scheme
7.     Settlment of anomalies etc. etc.

Following instructions should be strictly implemented in all Circles/Divisions without fail.
1.      Start campaign programme immediately. Issue circulars, notices and posters, conduct Divisional level Conventions/Meetings, Organise squad work to meet employees of all offices including GDS, Print 15 Charter of Demands in local languages and circulate among all employees including GDS.
2.      Circle Secretaries and all Circle Union office bearers should undertake campaign meetings at all important centers. Involvement of every Circle/Divisional Union office bearer in the campaign programme should be ensured.
3.      Campaign/Tour Programme of All India office bearers is enclosed herewith. Please contact the leaders over phone and arrange meetings not later than 7th February 2014.
4.      Draft Copy of the strike notice will be exhibited in the website. All Circles/Divisions should serve strike notice to their circle/Divisional Heads on 21.01.2014 with mass demonstration.

INSTRUCTIONS
1.     CHQ Office Bearers should contact Circle Secretaries and fix the date of meeting immediately.
2.      Campaign Programme should be completed before 5.2.2014.
3.      All Circle Secretaries should issue circulars in their local languages to their Division/Branches to make the strike 100% success.
4.      Copy of the circulars issued by the Circle Secretaries should be sent to their respective CHQ and also NFPE HQ.

5.      Success of the strike in each circle depends upon the initiative taken by the Circle Secretaries and Circle Union office bearers. They should contact all Divisional/Branch Secretaries and day-to-day monitoring should be done regarding the preparations for the strike in each Division. If there is any weakness in any Division, Circle Secretary should personally visit those divisions and ensure successful strike.
