FLASH STRIKE AGAINST PF RULES RESTRICTIONS IMPOSED BY CENTRAL GOVERNMENT



The flash strike against the recent PF Rules, 2016 of the Central Government (i.e., Centre’s new rule on Provident Fund withdrawal) by large section of Garment Factory Workers and other Industrial Workers of Karnataka State on 18th and 19th April 2016 received immense response and there was a massive protest which resulted in road blocks for hours together, thereby the entire traffic of Bengaluru City was paralyzed.  The traffic was also severely affected on Mysore, Tumkur and Hosur roads. 

             The COC Karnataka extended moral support and sympathy for this Labour Movement.  The February 10thnotification was under attack from trade unions from the beginning.  The notification was published in the gazette onFebruary 26 and created technical problems.

            The violence in Bengaluru prompted the Labour Ministry, Govt. of India to cancel the February 10 notification which put restrictions on 100% withdrawal from the PF account.

        Within few hours of protest in Bengaluru and other parts of Karnataka state , the Hon’ble Minsiter for Labour, Shri.Bandaru Dattatreya acted upon and withdrawn the notification issued on February 10th and informed that the old system will continue. This is a victory for the workers of the country.
GOVERNMENT DECIDES TO WITHDRAW THE 10th FEBRUARY-2016 NOTIFICATION WITH IMMEDIATE EFFECT

            Government had issued a notification dated 10th February 2016 regarding rules for withdrawal from EPF Funds by the members. Under the revised rules, the employee was permitted to withdraw the employees’ share from the fund (which is 12% of the wages). However, it was prescribed that the employers’ share of contribution towards the Provident Fund (which is 3.67% of wage) would be allowed to be withdrawn only at the age of retirement (58 years). The objective was to provide a minimum social security to the workers at the time of retirement. It was noticed that over 80% of the claims settled by EPFO belonged to pre-mature withdrawal of funds, treating the EPF accounts as savings accounts, and not a Social Security instrument. 

            In order to address the issues the amendment stated above was carried out with the consent of Trade Unions and with the intention of promoting a decent accumulation of provident fund for the members at the end of their working lifetimes. 

            However, considering the representations received from various quarters and after consultations with the various stakeholders, Minister of State (IC) Labour and Employment, Sh Bandaru Dattatreya announced that the government has decided to withdraw the said 10th February 2016 Notification with immediate effect. 

            Accordingly, the workers are now allowed to withdraw the entire amount from the provident fund as per existing provisions of the EPF Scheme 1952 including the employers’ share of 3.67%.   (Release ID: 139046) 21stApril,2016.

ON SECOND THOUGHT, DOPT DOES NOT WANT TO
SCRAP PENSIONS ACT.

            New Delhi: The Department of Personnel and Training (DoPT) has decided against scrapping a 145-year-old law, which exempts pension from being “attached or sequestered”, though a bill seeking its abrogation from statute book has already been passed by the Lok Sabha.

            Earlier, the DoPT had asked the Law Ministry to include the Pensions Act, 1871 in the repealing bill so it could be removed from the statute book. One of the key provisions of the law is that it exempts pension from attachment by any court. But later, it wrote to the Law Ministry to remove the Act from the repealing bill.

            After its passage in the Lok Sabha, the Repealing and Amending (Third) Bill, 2015 is pending in the Rajya Sabha.

            The Law Ministry is the nodal agency for repealing laws which have lost relevance today.

            A senior government functionary said that perhaps the realisation that there is no other law in the country which protects pensions led to decision against scrapping the Act.

            After the DoPTs request, the Law Ministry approached the Union Cabinet to clear an official amendment to remove the Pensions Act from the repealing bill.

            On March 23, the Union Cabinet cleared the official amendments, paving way for the passage of the bill in the upper house. After being cleared by the Rajya Sabha, the bill will travel back to the Lok Sabha to clear the official amendments.

            Section 11 of the Act states that “No Pension granted or continued by government on political considerations, or on account of past services or present infirmities or as a compassionate allowance, and no money due or to become due on account of any such pension or allowance, shall be liable to seizure, attachment or sequestration by process of any court at the instance of a creditor, for any demand against the pensioner, or in satisfaction of a decree or order of any such court.”

            Another official amendment cleared by the Union Cabinet relates to the Appropriation Acts (Repeal) Bill, 2015. The bill, cleared by the Lok Sabha and pending in the Rajya Sabha, seeks to repeal The Punjab Appropriation Act among other laws. But the Punjab Appropriation   Act has already been repealed by the Punjab Legislative Assembly and “inadvertently” became part of the Appropriation (Acts) Repeal Bill, 2015.

The Venue will be CHENNAI itself. All India Women’s Convention of Confederation will also be held along with the All India Conference.

        As per the decision of National Secretariat of Confederation  the Diamond Jubilee year  All India Conference of The Confederation of Central Government Employees and Workers, will  be held on 16th,17th& 18th  August 2016 at Chennai.  Accordingly, the Formation of Reception committee meeting was held on 5-4-2016 in ITEF Room in Chennai. 

            Leaders from all the Central Trade Union organisations participated in the meeting. The meeting was presided by the President Confederation Tamilnadu Com. J. Ramamurthy, welcomed by Com. S.Sundaramurthy, Treasurer and the General Secretary of the Confederation Tamilnadu Com.M. Duraipandian announced the Office Bearers of the  Reception Committee and other committees.

       As per the decision the Hon`ble Member of Parliament Com.T.K.Rangarajan will be  the Chairman Reception committee.  Nearly 15 Vice Chairman including Com.M.Shanmugam, General Secretary, LPF, all India president of HMS Com.C.A. Rajashridhar, Com.T.M. Murthy General Secretary, AITUC. State President of CITU, Com. A. Soundararajan, MLA, among others.  Leaders from various other organisations including Com.R. Tamilselvi, TNGEA, Com.R. Elangovan, DREU, Com.Sendhi kumar, SBI Officers Association, Com. Shanmugam from BEFI,   felicitated and extended support for the successful conduct of the conference.

       Earliar the president of the Confederation Com.KKN. Kutty and Com. M. Krishnan, Secretary General addressed the meeting. All India Women’s Convention of Confederation will also be organized along with the All India Conference. Tamilnadu State Conference of the Confederation will be held on 15th August, 2016 in the same Venue.

      In the Reception Committee, under the Chairman Reception Committee Com.T.K.Rangarajan, alongwith 15 Vice Chairman Com. M. Duraipandian will be the General Secretary Reception committee and Com.S.Sundaramurthy, will be Treasure Reception Committee. Nearly 25 General Secretaries from the other affiliates of the organisations will be the Assistant Secretaries for the various sub committees of the Reception Committee for the successful conduct of the Conference. The meeting was concluded with the vote of thanks offered by Com.M.S. Vengatesan, General Secretary of ITEF Tamilnadu Circle.

Dear comrades,

As per the decision in our AIC MASS DHARNA was conducted successfully at        JANTAR MANTAR, DELHI on 9th Feb 2016 with the solidarity and support of NFPE & NFPE affiliated unions. Nearly 100 members from all over India attended the DHARNS particularly large number from MAHARASTRA CIRCLE. DHARNA was addressed by all general secretaries and secretary general, NFPE. Com. M. KRISNAN, GS CONFEDERATION AND OUR PRESIDENT participated in the DHARNA. After the DHARNA a delegation with com. R.N. PARASAR, SG NFPE met member [p] and submitted memorandum. He assured to examine the issues positively.

            After wards  MASS DHARNA was conducted IN FRONT OF ALL CPMG OFFICES ON 22-3-2016.now as a further action it was decided to conduct DHARNA INFRONT OF ALL DIVISIONAL OFFICES IN THE COUNTRY ON 10-5-2016. As such we appeal to all circle/Divisional secretaries of NFPE unions to organize the programme by taking initiative to mobilize casual labour in large number by issuing notice by divisional co-ordination committee.

            Without the support and solidarity it will not be possible to organize the programme on their own by casual labour.

            As such we request all the circle/divisional secretaries of NFPE to organize the programme. SECRETARY GENERAL NFPE & All general secretaries are requested to advise circle unions to make the programme success and keep this in websites.

GDS MEMBERSHIP VERIFICATION
OUR RESPONSIBILITIES AND IMMEDIATE TASK  ELECT AND SELECT AIPEU-GDS AS THE ONLY ONE RECOGNISED GDS UNION
Dear Comrades,
                   As all of you are aware Department of Posts has commenced the process of verification of membership of Gramin Dak Sevaks for grant of recognition.  The AIPEU-GDS was formed in the year 2012 and the Federal Council of NFPE held at Hyderabad in 2013, which is the highest decision and policy making body of NFPE, has decided to grant  “Associate Membership” to the newly formed AIPEU-GDS.  For the last four years, AIPEU-GDS is functioning without recognition and joined all the programmes of NFPE including strike.  During this four year period it had conducted two All India Conferences and formed Branches in all the 22 Circles.  After formation of AIPEU-GDS, it is the first membership verification taking place.
                   There is no doubt that the AIPEU-GDS will get recognition and shall become number one recognised GDS Union, with flying colours.  But that is not enough - we should make the AIPEU-GDS as the only one recognised GDS Union in the Department of Posts.  It is not impossible.
                   For fulfilling the above task, all Circle/Divisional Branches of NFPE affiliated Unions/Associations and also all CHQ office bearers are hereby requested to take immediate action to implement the following directions of NFPE.
1.                It should be ensured that Circle/Divisional Unions of AIPEU-GDS is formed in all Circles/Divisions.
2.                The name, designation and official address of the Circle/Divisional Secretaries should be intimated to “Com.P.Panduranga Rao, General Secretary, AIPEU-GDS, 1, Patel Road, Shadipur, Dada Ghosh Bhavan PO, New Delhi-110 008”.  Email ID: aipeugdsnfpe@gmail.com  Mob: 09849466595.  Divisional Secretaries should inform the above particulars to Circle Secretaries also.
3.                Still there are some divisions where the branches of AIPEU-GDS are not yet formed, inspite of repeated instructions from NFPE.   All those Divisions where the branch of AIPEU-GDS is not yet formed should form the Branch Union or at least an Adhoc Committee at Divisional level with a Secretary or Convenor before 15th April 2016.  The name, designation and official address with pin code and mobile number of the newly elected Secretary or Adhoc Committee Convenor should be intimated to the General Secretary and Circle Secretary.  Wherever Circle Unions are not functioning immediate action should be taken to form a functioning Circle Union or Circle level Adhoc Committee of AIPEU-GDS.
4.                It is reported from some circles that some P3 and P4 Divisional Unions of NFPE has not taken any positive action to form the Divisional Branches of AIPEU-GDS.  Not only that in some limited divisions, the rival GDS Union, which is campaigning against NFPE and has formed separate unions for Group-C and Postmen/MTS in the name of “UNITED” to break our P3 and P4 Union and thereby to destabilise NFPE, is given all help and assistance by the some P3 and P4 Unions of NFPE and also holding joint meetings with the rival GDS Union which is no more an affiliate or Associate of NFPE.  This is not permissile and is in violation of the directions and guidelines issued by NFPE.  It is once again made clear that disciplinary action will be taken against those divisions which refuse to form the branches of AIPEU-GDS and which are still cooperating and extending all help to the rival GDS Union and conducting joint meetings.  The recognition of all such Divisional Unions which refuse to carry out the directions of NFPE will be withdrawn without any further notice.
5.                Last date for submission of application by GDS Unions for participating in the membership verification process is 31-03-2016.  AIPEU-GDS has already submitted application to the Directorate on 18-03-2016.  Please note that the name of our union is “AIPEU-GDS”.  Department may issue orders fixing the last date for submission of authorisation forms to the Divisional heads, along with the model authorisation form with the signature of an officer of the Directorate.  Immediately on publishing the authorisation form by the department all the affiliated unions of NFPE should jointly jump into action and collect maximum number of authorisation forms from GDS of each division.  As GDS are working in remote villages, action plan should be chalked out now itself, for visiting each and every Branch Post Office by the NFPE leadership, for collecting authorisation forms signed by the GDS in favour of AIPEU-GDS.
6.                AIPEU-GDS is the GDS Union of NFPE and it is the collective responsibility of all Circle/Divisional Unions of NFPE to make our GDS Union as the only one recognised union.  Let us take it as a challenge and prove that it is possible.

AIPRPA FORMATION IN TINSUKIA

            After its capital 'Guwahati' formed its AIPRPA on 27th March, Dibrugarh formed on 6th April, and another District 'Tinsukia' formed its AIPRPA yesterday on 7.4.2016, the Assam State is moving faster towards its State formation. With the initiative of NFPE unions under the guidance of P3 Divisional Secretary comrade Aditya Bhattacharjee. Venue and all help was extended by All India BSNL DOT Pensioners Association led by comrades Peasanta Bhattacharjee and C.R.Barthakur. KR GS AIPRPA, S.Rahman VP NCCPA, and M.K.Purakayastha Ex-CHQ Steering committee member addressed.

            Large number of pensioners from both postal side and RMS side and also some family pensioners attended with keen enthusiasm. The president ship to the meeting was chaired by senior most comrade Ashim  Kumar Dutta. After interactions a list of office bearers led by comrades Ashim  Kumar Dutta as President; D.D.Sonowal as District Secretary; and Pankaj Dhali as Treasurer.

             Some comrades there itself enrolled as annual subscribers to CHQ monthly journal 'Pensioners Post'. Comrade Mrs.Bakul Dey P3 Divisional President remained throughout the meeting and assured full cooperation.



ONE MORE STEP IN THE DIRECTION OF FORMING A STRONG AIPRPA OF ASSAM STATE!

            An excellently organized meeting of Postal & RMS Pensioners at the effort of Comrade Mausumi Mazumder P3 Divisional Secretary today formed the Association of AIPRPA. The meeting was presided over by comrade Moheswar Bora, a seasoned leader of postal movement and a pensioner. KR GS AIPRPA; S.Rahman Vice President NCCPA; and M.K.Purakayastha former AIPRPA CHQ Steering Committee Member addressed. After interactions the meeting unanimously elected a list of office bearers with comrades Moheswar Bora as President; Arun Uday Bhattacharjee as District Secretary; and Subir Mazumdar as Treasurer. Senior most pensioners with standing comrades Sunil Banerjee and Malbhog Barpartra were named as Patrons. Comrades Mausumi Mazumder and Jaba  Kushum Chandra respectively the Divisional Secretary and President of P3 NFPE Unions are named as Advisors. The venue of the meeting was arranged in a big hall by the P3 Divisional Secretary and under the efficient leadership of both comrades Mausumi and Java Kushum the meeting was a grand success! - KR GS AIPRPA.

SOCIO-ECONOMIC SURVEY OF BOS - REGARDING NAMES OF BOS TO INCLUDE IN THE SAMPLE SURVEY.
Dear Friends,

            The GDS Committee is proposing to conduct a socio-economic survey of selected Branch post offices and Gramin Dak Sevaks to collect the information.  For the purpose, a sample size of 1500 Branch Post offices have been identified, with proportionate representation, with the help of the Circles.

Since the Committee considers Federations / Unions as important stakeholders in the entire process, it is decided that approximately 10% of the BOs which will be surveyed should be identified by Federations / Unions. 

In view of the above, it is requested to kindly send names of two BOs from each Circle (maximum 50) to include them in the sample size.  The BOs selected should be representative of the overall existing conditions of BOs in the country. The names should reach us by 14.4.2016 in the following format, as we have planned a work shop for nodal officers from the Circles on 19.4.16 at RAKNPA.

            Com. R. Sivannarayana, All India Leader of AIPEU Gr.C  retired from  service in the Department of Posts on  29-02-2016 in Guntur. On the occasion of this event, felicitation function has been organized by NFPE comrades of Guntur division on 13-03-2016, at NGO Kalyana Mandapam, Guntur.

            The meeting includes the strike campaign, organizational aspects and function of felicitation. It is chaired by Com.J.Ramasubbaiah, Com.K.Purushottam, Com.M.Subbarao, Presidents of Gr.C., P4 & GDS of Guntur Division. All Leaders addressed the distinguished gathering by expressing their views on the organization and recollecting the individual experiences with Com.R.Sivannarayana.

            The biography of Com.R.Sivannarayana  is recollected in this occasion. Com.Sivannarayana is the native of Guntur district born in a village near by Guntur city in a middle class agricultural family. He entered the service by recruitment in 1979, posed first in Karimnagar. There after worked in Peddapalli, Vijayawada, West Krishna and lastly transferred to Guntur in 1985. He joined as Postal Assistant and retired as PA only.

            From the date of his joining, started working  in NFPE organization and elected as Divisional Secretary, P3, Guntur in 1987. Under the provisions of New Recognition Rules, 1993, elected as Divisional Secretary, AIPEDEU during 1997.

            His first election to All India Organization, P3 as Vice President, CHQ in 1997 All India Conference, Mathura(UP) . It was continued upto 2006 Jwalaji (HP) Conference and there elevated to the post of Asst. General Secretary. In the All India Conference held at Allendi (Maharashtra) 2011, comrade has been elected to the post of Deputy General Secretary to render his service for the organization. In the year 2013 Trivendrum All India Conference he has been elected as All India President and continued up to 2015 All India Conference held at Lucknow.

            During 2012, after the retirement of Com.K.V.Sridharan as General Secretary, he has taken charge from Com.KVS and assumed the office as Officiating General Secretary till next AIC and worked in CHQ.

            In 2013 All India Conference he handed over the charge of the post of General Secretary to Com.M.Krishnan, elected as General Secretary, Gr.C. held in Trivendrum and taken the charge of All India President from Com.M.Krishnan in the same AIC.

            He always proud to announce that Com.M.Krishnan as his LEADER and Com.KVS as his GURU in all occasions and treated by them as a family member.

            He availed about 3 ½ years foreign service provision and stayed in CHQ to extend all services  not only to the Gr.C CHQ but also to the NFPE organizations to the best of his efforts during the period.

            The valuable publications of Gr.C CHQ viz., VENTURE, POINEER, HAND BOOK, CD on RULINGS, BHARATIYA POST, GDS CRUSADER, GDS REFRESHER & SOUVENIERS, CWC REPORTS, AIC REPORTS, PAY COMMISSION REPORTS  etc., have been released successfully with the earnest  and sincere contribution of Com.Sivannarayana with all his commitment and dedication to the organization. Till his retirement from service, he extended the services to CHQ  in all aspects.

            Com.Sivannarayana, with all his capacity, organized the All India Conference of P3 CHQ during November 2008 in a very prestigious manner and made it grand success by conducting AIC in such a way caused to continue to hold the subsequent AICs in A/C conference halls. In his period of service, caused to conduct P3 Circle conference, P4 Circle Conference, CWC meetings, Conventions, Study camps, Trade Union Classes and many other organizational activities in Guntur with support and cooperation of NFPE and Trade Unions of Guntur.

             A grand function has been arranged by NFPE comrades, Guntur to honour Com.R.Sivannarayana on his retirement in his home city. Many of the All India leaders viz., Com.M.Krishnan, Secretary General, Confederation, former Secretary General, NFPE and General Secretary, Gr.C., Com.R.N.Parashar, Secretary General, NFPE, Com.K.V.Sridharan, former General Secretary, Gr.C., Com.Giriraj Sing, President, NFPE & G/S, R-3., Com.J.Ramamoorthy, All India President, Gr.C., Com.R.Seetalakshmi, General Secretary, P4., Com.P.Pandurangarao, General Secretary, GDS., Com.K.Ramachandram, All India President, Admin. Union., Com.P.Mohan, General Secretary, Casual employees Federation, Com.K.Manoharan, Vice President, NFPE., Com.A.Veeramani AGS, CHQ., Com.Y.Nagabhushanam, Working President, Casual employees Federation, Com. S. K. Humayun, Ex-CHQ President, P4, Com. G. C. Narasimhulu, Veteran Leader, P3, TamilNadu are present to participate in the function.

            Many other leaders viz., V.Sambasivarao, Veteran Leader, BSNL., Com. D.L.Kantharao, Veteran Postal Leader, Tenali, Com.R.J.Madhusudanarao, Circle Secretary, R3., Com.V.Shivaji, Circle Secretary, P3, FNPO., Com.Ch.Vidyasagar, Circle Secretary, P4., Com.K.N.Chary, ACS, GDS., Com.Y.Netaji, District Secretary, CITU., besides from administration side shri D.Satyanarayana, Supdt of Pos, Guntur, Hari Prasad Sharma, Chief Postmaster, Vijayawada HO, Shri K.S.Venkateswararao, SPOs, Tenali, Shri Jayaraj, SPOs, PSD, Hyderabad, Shri Veerareddy, SPOs (retd), Y.Janardhan Sharma, SPOs (retd), ASPS & Inspectors of Posts are also witnessed the function.

            A tradition & custom of hindu family is also observed during this function. After attaining the age of 60, Smt. Bapamma & Shri Sivannarayana is offered the blessings and greetings of many elders as it is called “Shashtipurthi mahotsavam” along with his family members Smt.Madhavi (daughter) & Shri V.V.S.R.K.Prasad, Shri R.Venu (son) & Smt Yamini with their children and Kum.Ashwini (daughter). Shri J.C.Venkateswarlu (Brother), former District Governor, Lions club., Shri R.Venkateswarlu (brother) also blessed and greeted them.

            More than 1000 participants representing from various sections viz., Leaders of NFPE, Postal divisions comprising divisional & branch secretaries, active members, well wishers, friends, family members, FNPO leaders graced the function in a festive way with pleasant atmosphere.

             The team of Com.M.Ramakrishna, Com.B.Ramarao, Com.K.Burraiah, Com. M. Srinivasarao, Com.Subbarao and many others represented their responsibilities with all efforts and commitment with affection towards Sivanna deserves all appreciation and made it a grand and historic success.

ALL INDIA TRADE UNION EDUCATION CAMP
DEHRADUN, MAY 24 & 25, 2016

Dear Comrades,

            s decided in the National Secretariat Meeting, the next All India Trade Union Education Camp of Confederation of Central Govt. Employees & Workers will be held on 24th and 25th May, 2016.  The Dehradun Unit of the Confederation has come forward to host the said camp at Dehradun on the above days and started the Preparatory work for the programme.  It should be the endeavour of all affiliates and State Units of the Confederation to depute the given number of delegates to the camp and make it a grand success. The quota fixed for each affiliate/COC is given below.  Detailed programme & notice will be sent shortly.  TU Camp will commence at 10 AM on 24th May and continue till 5 PM on 25th May, 2016 and the delegates should ensure their presence throughout the duration of the Camp.   

            Delegates from all affiliated organisations and C-O-Cs should compulsorily attend the TU camp.  The minimum quota fixed for each affiliated organisation and C-O-Cs is given below.  All are requested to ensure participation of delegates as per quota fixed, WITHOUT FAIL.  Delegates may be instructed to book their up and down tickets immediately. Delegate fee per head is Rs. 600/- (Rs. Six hundred only). All delegates, including All India office Bearers of Confederation should pay the delegate fee.
