GRAMIN DAK SEVAKS – REVISION OF WAGES AND SERVICE CONDITIONS SHOULD BE INCLUDED IN 7TH CPC

In the discussion held on 05.02.2015 with the Postal Joint Council of Action (NFPE, FNPO, AIPEU-GDS (NFPE) and NUGDS), Secretary, Department of Posts has assured that the demand for inclusion of GDS under 7th CPC will again be referred to the Government by the Postal Board. If all the Postal Federations and Unions/Associations join together and go for an indefinite strike from May 6th as decided by the PJCA, Government will be compelled to include GDS under 7th CPC.

But the recognised GDS Union is demanding separate committee and conducting separate strike, breaking the unity of five lakhs Postal employees. Separate strike for a separate

In order to give boost to the tourism sector, the Budget for 2015-16 is likely to expand the scope of LTA and LTC by including hotel and other expenses besides travel for the purpose of tax benefit.

The Ministry, sources said, it is also considering a proposal to allow employees to avail Leave Travel Concession (LTC)/ Leave Travel Allowance (LTA) every year as against the current practice of two times in a block of four years.

At present, LTA or LTC covers only economy class air travel or first class (AC I Class) rail fare. An announcement in this regard is likely to be made in the Budget to be presented by Finance Minister Arun Jaitley on February 28.

Prime Minister Narendra Modi had earlier expressed his keenness to promote tourism. Experts are of the view that encouragement to the tourism sector will promote development of different regions and create employment opportunities.

"To boost domestic tourism and also provide some tax relief to the individuals, the Leave Travel Concession benefit should be increased to one visit for every financial year," KPMG (India) Partner Vikas Vasal said.

He further suggested that tax concessions should also be made available for stay in hotel may also be covered to help families avail of a holistic benefit.

The LTC/LTA is available to the individual and his family including spouse, two children, parents, brothers and sisters, who are wholly dependent on the assessee.

Therefore, Ministries/Departments are advised to ensure strict compliance to the time limits indicated in MACPS for grant of benefits under this scheme as and when the employees become eligible for such benefits".

Subject:-MODIFIED ASSURED CAREER PROGRESSION SCHEME FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES - instructions regarding,

This Department on the recommendation of Sixth Central Pay Commission in Para 6.1.15 of its report and in supersession of previous Assured Career Progression Scheme, vide O.M. No. 35034/3/2008-Estt.(D) dated 19.05.2009 introduced the Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees which is operational w.e.f. 01.09.2008. MACP Scheme envisages the three financial upgradations at intervals of 10, 20 and 30 years of continuous regular service to all regularly appointed Group “A”, “B”, and “C” Central Government Civilian Employees.

2. As per para 6 of DOPT’s O.M. No. 35034/3/2008-Estt.(D) dated 19.05.2009, the Screening Committee would follow a time-schedule and meet twice in a financial year – preferably in the first week of January and first week of July of a year for advance processing of the cases maturing in that half. Accordingly, cases maturing during the first-half (April-September) of a particular financial year would be taken up for consideration by the Screening Committee meeting in the first week of January. Similarly, the Screening Committee meeting in the first week of July of any financial year would process the cases that would be maturing during the second-half (October-March) of the same financial year.

3. It has come to notice of this Department that the benefits of MACPS are not being granted as per the schedule/provisions in the MACP Scheme leading to dissatisfaction and grievances among the employees. Therefore, Ministries/Departments are advised to ensure strict compliance to the time limits indicated in MACPS for grant of benefits under this scheme as and when the employees become eligible for such benefits.

GDS COURT CASE – UPDATE

Delhi High Court has directed Central Administrative Tribunal, Principal Bench, New Delhi to list the GDS case filed by NFPE & AIPEU – GDS (NFPE) for next hearing on 18th March 2015. The High Court also directed that the file of this case should be made available to the Registrar, Central Administrative Tribunal on the above date fixed by High Court.

TEARFUL RED SALUTE to Com. S.K.VYAS

   COMRADE S.K. VYAS  NO MORE 

With deep grief and extreme sorrow, it is intimated that Com. S.K.Vyas, the legendary leader of the Central Govt. Employees and   Pensioners, is no more. He passed away at about 08.20 PM on 13 February 2015, at  a Jaipur hospital, where he was admitted a few days back after a massive heart attack. He was recovering, but all of a sudden, the situation worsened and he passed away.
He was 85 years.
His funeral will take place at Jodhpur on 14th Feb 2015. Com.Vyasji was the Secretary General of the Confederation of Central Govt. Employees and workers since 1967 for more than four decades. He was holding the posts of Secretary General of both BCPC and NCCPA, Federations of Pensioners Associations till his end.
His death is an irreparable loss to the entire CGE and Pensioners movement.
Our heartfelt condolences to the bereaved family, friends and comrades.

Comrades,

            Staff Side PJCA meeting was held at NFPE Office, North Avenue Post Office Building, New Delhi-110 001 on 04th February,2015 under the Presidentship of Com. D. Theagarajan Secretary General FNPO. All General Secretaries of NFPE, FNPO and GDS Unions participated in the meeting.

            The following decisions were taken in the meeting:

1.         Formation of PJCA at all Circles:

            Reviewed the position of formation of Circle JCA. PJCA has been formed in some Circles and in some circles it is functioning well. The Circles in which the PJCA is not functioning, it should be formed by the respective CHQ leaders..All Circle Secretaries should also take it seriously and inform the CHQ and Federation after formation. This work should be completed before 15th February, 2015.

2.         Strategy was decided for the meeting to be held with Secretary Post at Dak Bhawan , New Delhi on 05.02.2015.


MEETING OF PJCA  LEADERS WITH SECRETARY POST

            Meeting of PJCA leaders was held with Secretary (Post) and other higher officers of Postal Board. Though Secretary (Post) gave positive assurances on most of the issues and also assured that Deptt. Is not going to implement recommendations of Task Force Committee report and there will be no corporatization and Privatization of Deptt. and before implementation of any new scheme it will be discussed with unions and after getting the consent of unions it will be implemented. Secretary (Post) also agreed to refer again the case of GDS wage revision and other service conditions to Government of India for inclusion in the 7th CPC. She also assured to finalize the Cadre restructuring proposal of all Cadres before 30th April-2015.

            Though Secretary (Post) has given many of the positive assurances but keeping in mind the style of functioning and political and economic policies of Central Government we cannot believe as they are implementing all Globlization   and privatization policies very intensively in all the sectors and mostly employees of all sectors are agitated and moving on path of agitation.

            Therefore, we appeal to all Leaders and entire rank and file to get ready for struggle and observe the following programme of action in a phased manner on 40 points Charter of Demand:

1,         Formation of JCA at all levels before 15th February, 2015.
2.         Dharna infront of Divisional Offices on 20th February, 2015.
3.         Dharna infront of Regional offices on 27th February, 2015.
4.         Dharna infront of Circle Offices on 2nd March, 2015.
5.         Dharna by all India Leaders at Directorate, New Delhi on 15th April, 2015.

GDS COURT CASE - LATEST POSITION

GDS Court case (Writ Petition) filed by NFPE & AIPEU -GDS (NFPE) in the Supreme Court was transferred to Delhi High Court by Supreme Court.. In the meantime another case was filed by some GDS in Supreme Court through another Advocate. In that case their Advocate has agreed to file a case in Central Administrative Tribunal for getting the benefits of regular employees to GDS . Accordingly Supreme Court has given a judgement permitting them to file case in CAT. It is in this background our case in the Delhi High Court came up for hearing on 4th February 2015. The Delhi High Court has given a verdict to transfer the entire case filed by NFPE & AIPEU - GDS (NFPE) to CAT Principal Bench, New Delhi. There is no need to file separate case in CAT. Delhi High Court case will be transferred to CAT by High Court. We have decided to argue our case in CAT Principal Bench New Delhi and continue our legal battle for justice till end. In CAT it will take maximum four months for Judgement.

Com S. K. Vyasji, Veteran Leader of Central Govt. Employees and Advisor Confederation had a massive heart attack and admitted to hospital at Jaipur. Now he is recovering. Confederation National Secretariat wishes him speedy recovery. Prevention of Sexual Harassment of Women at the Workplace – Amendments to CCS(Conduct)Rules 1964.

Subject: Central Civil Services (Conduct) Rules 1964 — Guidelines regarding prevention of sexual harassment of women at the workplace— regarding

Following the promulgation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [SHWW (PPR) Act] and notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 [SHWW(PPR) Rules] on 09.12.2013., the Government has recently, on 19.11.2014, notified the amendments to Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965. 

The amendments and other salient features of the Act/ Rules was brought to the notice of all concerned vide Office Memorandum of even no. dated 27.11.2014. The amendments to the Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965 and the Office Memorandum dated 01.12.2014 are available on the Department’s website.

2.         The following guidelines, conveying the decision of the Committee of Secretaries on this subject, were issued vide this Department’s Office Memorandum No. 11013/3/2009-Estt.(A) dated 03.08.2009, “As regards provisions for protection of women, it was suggested that the complaints committee mechanism provided under Vishakha guidelines relating to sexual harassment should be strictly in accordance with the judgment and steps should be taken to ensure that the committee is effective and functional at all times. It would also be desirable for the Committees to meet once a quarter, even if there is no live case, and review preparedness to fulfill all requirements of the Vishakha judgment in the Department/Ministry/ organization concerned.”

3.         As per the guidelines issued vide Office Memorandum dated 21.07.2009, it is also to be ensured that the Complaints Committee shall at all times be in existence and changes in its composition, whenever necessary, should be made promptly and adequately publicized. The composition of the Complaints Committee should also be posted on the websites of the concerned Ministries/Departments/Offices concerned.

4.         Vide the Office Memorandum dated 01.12.2014, the attention of the Ministries/Departments was also invited to the reporting requirements mentioned in the SHWW(PPR) Act and SHWW(PPR) Rules.

5.         All Ministries/ Departments are requested to please review the progress of implementation of the existing abovementioned guidelines issued in the aftermath of the Vishakha judgment.

6.         Attention of all Ministries is invited to Section 22 of the Act relating to including information in Annual Report, and to request that information relating to number of cases filed, if any, and their disposal may be included in the Annual Report of the Ministry / Department.

7.         All Ministries / Departments are also requested to furnish an annual return (as on 31 stMarch) in the enclosed proforma to this Department by 30th April every year.
